Terms and Conditions

These terms outline the general conditions that apply to projects completed by Tame Your Terrain. Individual estimates may contain additional project-specific terms.

1. Fixed Price Agreement

Projects are quoted as a fixed job price, not by the hour and not by the acre. The agreed price is based on Tame Your Terrain's site evaluation, expected conditions, access, and the agreed scope of work.

2. Deposit and Final Payment

A 25% non-refundable deposit is required before a project is placed on the schedule. The deposit reserves the project dates and is applied toward the total project price. The remaining balance is due upon project completion unless another payment arrangement has been agreed to in writing before the project begins.

3. Scheduling and Delays

Start dates are estimates only. Weather, wet ground, equipment issues, hidden hazards, site access problems, and other unforeseen conditions may delay, pause, or require rescheduling of work. Tame Your Terrain will make reasonable efforts to communicate scheduling changes as soon as practical.

4. Site Marking, Permits, and Customer Responsibility

The customer is responsible for identifying and clearly marking property lines, utilities, septic systems, wells, drain tile, buried wire, fencing, obstacles, and any other hidden hazards. The customer is also responsible for obtaining any permits, approvals, permissions, or authorizations required for the work before the project begins. Tame Your Terrain is not responsible for damage to unmarked items or delays caused by missing permits or approvals.

5. Surface Conditions and Results

Forestry mulching, land clearing, and trail work may leave uneven surfaces, track marks, rutting, wood chips, and natural ground disturbance depending on weather, soil conditions, vegetation, and terrain. A finished lawn, smooth final grade, driveway finish, or landscaped surface is not included unless specifically stated in writing.

6. Additional Work

Work outside the original agreed scope, including extra acreage, heavier-than-expected conditions, hidden debris, additional cleanup, added finishing work, or other requested changes, may require customer approval and additional cost before proceeding.

7. Hidden Hazards and Equipment Damage

If hidden metal, wire, concrete, buried debris, or other damaging materials are encountered, work may be paused. Damage, downtime, repair costs, cleanup costs, or disposal costs caused by undisclosed hazards may be charged to the customer.

8. Hidden Debris and Additional Cleanup Costs

If hidden debris is encountered, including but not limited to wire, fencing, scrap metal, garbage, concrete, tires, or other foreign materials not visible during the initial site evaluation, a $500 charge will apply per occurrence.

These materials can significantly reduce productivity, increase equipment wear, and require additional time for safe removal or handling.

The $500 charge covers the disruption and additional handling associated with each hidden-debris occurrence and does not limit responsibility for extraordinary equipment damage, repair costs, disposal costs, or other expenses caused by undisclosed hazards.

If these conditions are encountered, Tame Your Terrain reserves the right to pause work, reassess the project scope, and apply additional charges based on time, difficulty, cleanup requirements, disposal requirements, and equipment impact. Where possible, the customer will be notified before work continues under revised conditions. Immediate action may be taken when necessary to protect equipment or maintain safety.

9. Cancellation

Once a project has been scheduled, the deposit is non-refundable because project time has been reserved and may no longer be available to other customers.

10. Safety and Site Conditions

Safety comes first. Tame Your Terrain may limit, pause, or decline work in areas that are too steep, wet, unstable, inaccessible, or otherwise unsafe for equipment operation. Work may also be modified where conditions create an unreasonable risk to people, equipment, structures, utilities, or the property.

11. Project Photos and Video

Tame Your Terrain may take before, during, and after photos or video of project work for documentation and marketing purposes. Customer names, addresses, license plates, and other sensitive identifying information will not intentionally be published without permission.

12. Project-Specific Terms

Individual estimates, proposals, or written agreements may include additional terms, exclusions, access requirements, payment arrangements, or scope details specific to that project. If there is a conflict, the project-specific written agreement will control for that project.
